Detention order against Elahi withdrawn, DC informs court

 Islamabad, 12 September, 2023 (GNP):The detention order issued against PTI President Parvez Elahi under the Maintenance of Public Order (MPO) ordinance has been revoked, as confirmed by the capital deputy commissioner (DC) during proceedings at the Islamabad High Court (IHC) on Tuesday.

This development follows the Lahore High Court’s issuance of a bailable arrest warrant for Islamabad Inspector General of Police (IGP) Dr. Akbar Nisar Khan a day earlier, citing his failure to appear in court for a contempt case related to Elahi’s initial arrest.

On 1st September, shortly after the Lahore High Court had ordered Parvez Elahi’s release in a graft case, the PTI leader was re-arrested by Islamabad police under the MPO. Subsequently, the IHC suspended his MPO detention and ordered his release. However, he was re-arrested in a terror case just hours later.

Parvez Elahi is presently on judicial remand in the terror case, which is set to conclude on September 22.

During the recent hearing presided over by Justice Tariq Mehmood Jahangiri, Islamabad DC Irfan Nawaz Memon appeared before the court to convey that the detention order against Parvez Elahi had been withdrawn. As a result, the IHC disposed of Parvez Elahi’s petition. The court directed the DC to provide information about the FIR that currently justified Elahi’s custody.

In an earlier hearing, Justice Jahangiri had noted that Parvez Elahi had been detained for over three months, and the court had found the detention order to be passed without lawful authority and prima facie in violation of the Lahore High Court’s directives. The order suspended the detention and ordered Elahi’s immediate release if not required in any other case.
